Visselbl\u00e5sare \u00e4r en person som rapporterar om missf\u00f6rh\u00e5llanden. I lagen anges hur de ska skyddas. Lagen utg\u00e5r fr\u00e5n EU:s nya visselbl\u00e5sardirektiv och inneh\u00e5ller nya krav och r\u00e4ttigheter j\u00e4mf\u00f6rt med tidigare lagstiftning. Fler personer omfattas av skyddet och f\u00f6retagen ska inr\u00e4tta interna rapporteringskanaler. I detta Arbetsgivarnytt informerar vi om de st\u00f6rsta f\u00f6r\u00e4ndringarna.<\/p>\n<p>Lagens skydd f\u00f6r visselbl\u00e5sare g\u00e4ller i alla verksamheter, b\u00e5de i privata f\u00f6retag och offentliga verksamheter.<\/p>\n<p>Beroende p\u00e5 storlek, kommer f\u00f6retag ha mellan sex m\u00e5nader och tv\u00e5 \u00e5r p\u00e5 sig att genomf\u00f6ra n\u00f6dv\u00e4ndiga f\u00f6r\u00e4ndringar av sina system f\u00f6r rapportering av missf\u00f6rh\u00e5llanden och inr\u00e4tta \u201dvisselbl\u00e5sarkanaler\u201d efter att lagen tr\u00e4tt i kraft.<\/p>\n<p>Syftet \u00e4r att underl\u00e4tta och uppmuntra till visselbl\u00e5sning samt f\u00f6rst\u00e4rka skyddet f\u00f6r visselbl\u00e5sare. Det \u00f6vergripande motivet bakom EU-direktivet var att komma \u00e5t korruption, lagbrott mot EU-lagstiftning och bedr\u00e4gerier med EU-medel.<\/p>\n<h3>Nya visselbl\u00e5sarlagen mer omfattande<\/h3>\n<p>Den nya visselbl\u00e5sarlagen \u00e4r mycket detaljerad och omfattande. Men trots den nya lagens omf\u00e5ng t\u00e4cks mycket redan av dagens lagstiftning. Bland annat \u00e4r arbetsgivaren redan i nuvarande lagstiftning skadest\u00e5ndsskyldig gentemot en visselbl\u00e5sare om denne utsatts f\u00f6r repressalier. \u00c4ven bevisb\u00f6rdan ligger forts\u00e4ttningsvis p\u00e5 verksamhetsut\u00f6varen. Det har heller inte g\u00e5tt att avtala bort visselbl\u00e5sarskyddet.<\/p>\n<h3>G\u00e4ller en bredare personkrets<\/h3>\n<p>En av de st\u00f6rsta f\u00f6r\u00e4ndringarna med den nya lagen \u00e4r att en bredare personkrets omfattas av lagens skydd. Den nya lagen skyddar anst\u00e4llda, inhyrd personal, volont\u00e4rer, praktikanter, personer som annars utf\u00f6r arbete under er kontroll och ledning, egenf\u00f6retagare, personer som ing\u00e5r i ert f\u00f6rvaltnings-, lednings- eller tillsynsorgan, om verksamhetsut\u00f6varen \u00e4r ett f\u00f6retag och aktie\u00e4gare som \u00e4r verksamma i f\u00f6retaget, om verksamheten \u00e4r ett aktiebolag.<\/p>\n<h3>Missf\u00f6rh\u00e5llanden av allm\u00e4nintresse<\/h3>\n<p>Tidigare g\u00e4llde skyddet de arbetstagare som slog larm om \u201dallvarliga missf\u00f6rh\u00e5llanden\u201d i en verksamhet, i princip j\u00e4mf\u00f6rbara med brott d\u00e4r f\u00e4ngelse ing\u00e5r i straffskalan. Den nya lagen g\u00e5r l\u00e4ngre och skyddar \u00e4ven de som visselbl\u00e5ser om missf\u00f6rh\u00e5llanden d\u00e4r det finns ett allm\u00e4nintresse av att detta kommer fram. Brott mot lagar och f\u00f6reskrifter som g\u00e4ller f\u00f6r verksamheten \u00e4r exempelvis av allm\u00e4nintresse.<\/p>\n<p>Det ska finnas ett ber\u00e4ttigat intresse f\u00f6r allm\u00e4nheten att f\u00e5 reda p\u00e5 uppgifterna f\u00f6r att lagen ska ge skydd, till exempel ifall farliga produkter har kommit ut p\u00e5 marknaden eller skattemedel anv\u00e4nds felaktigt. Typiskt sett omfattas inte n\u00e5gon som rapporterar om sina egna anst\u00e4llningsf\u00f6rh\u00e5llanden eller l\u00f6n.<\/p>\n<h3>Krav p\u00e5 rapporteringskanaler<\/h3>\n<p>Verksamhetsut\u00f6vare med minst 50 anst\u00e4llda \u00e4r skyldig att inr\u00e4tta s\u00e4rskilda interna rapporteringskanaler f\u00f6r visselbl\u00e5sning, som ska kunna ske muntligen eller skriftligen.
