Det var ett slags undantagstillst\u00e5nd som gav arbetsgivarna m\u00f6jlighet att ensidigt best\u00e4mma. Men&nbsp;nu f\u00f6r\u00e4ndras allts\u00e5&nbsp;situationen:<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u2013 Jag skulle r\u00e5da arbetsgivare att ta det h\u00e4r tillf\u00e4llet i akt till att analysera de redan \u00f6verenskomna anst\u00e4llningsvillkoren f\u00f6r att se om det \u00e4r n\u00e5got som m\u00e5ste regleras om? Det \u00e4r viktigt att t\u00e4nka till kring dessa fr\u00e5gor. \u00c4ven om det kanske inte g\u00e5r att ta ett definitivt beslut om hur man ska organisera arbetet fram\u00f6ver, \u00e4r det fr\u00e5gor som kan beh\u00f6va pr\u00f6vas och ompr\u00f6vas f\u00f6r att hitta fram till en fungerande form.&nbsp;<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">F\u00f6r \u00e4ven om alla arbetsr\u00e4ttsliga regler g\u00e4ller som vanligt, kan det finnas mjuka v\u00e4rden att st\u00e4lla mot den h\u00e5rda juridiken, och att skapa f\u00f6ruts\u00e4ttningar f\u00f6r flexibla villkor kan gynna b\u00e5de arbetstagare och arbetsgivare \u00e4ven l\u00e5ngsiktigt. Nils Bergh m\u00f6ter ofta fr\u00e5gor fr\u00e5n medlemsf\u00f6retag ang\u00e5ende vilken r\u00e4tt de till exempel har att st\u00e4lla krav p\u00e5 att en medarbetare ska arbeta p\u00e5 distans:<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u2013 F\u00f6r den som ska nyanst\u00e4llas \u00e4r det enkelt: du som arbetsgivare f\u00e5r best\u00e4mma formerna f\u00f6r hur och var arbetet ska utf\u00f6ras, det \u00e4r ett erbjudande som den som ska anst\u00e4llas kan v\u00e4lja att acceptera eller inte. Men om det redan st\u00e5r i anst\u00e4llningsavtalet att arbetet ska utf\u00f6ras p\u00e5 till exempel Almegas kontor med adress Sturegatan 11, m\u00e5ndag till fredag, ja, d\u00e5 \u00e4r det avtalet som g\u00e4ller, s\u00e4ger Nils Bergh.&nbsp;<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">En arbetsgivare som vill att medarbetarna i framtiden ska jobba hemma tv\u00e5 dagar i veckan, f\u00e5r \u00f6ppna&nbsp;f\u00f6r&nbsp;en diskussion med medarbetaren om s\u00e5dan justering av anst\u00e4llningsavtalet. Att hitta en gemensam l\u00f6sning \u00e4r s\u00e5klart b\u00e4st, p\u00e5pekar Nils Bergh:<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u2013\u00a0Ytterst kan arbetsgivaren inom ramen f\u00f6r en omorganisation v\u00e4lja att s\u00e4ga upp de befintliga tj\u00e4nsterna och utlysa nya tj\u00e4nster, med nya villkor f\u00f6r var arbetet ska utf\u00f6ras. Det kan l\u00e5ta h\u00e5rt och det absolut vanligaste \u00e4r att de inblandade kommer till en \u00f6verenskommelse som passar b\u00e5da sidor. Det \u00e4r \u00e5terigen personalpolitisk det handlar om. Tro inte att det g\u00e5r att hitta en l\u00f6sning som fungerar f\u00f6r allt, utan ta hellre ett beslut f\u00f6r hur ni ska l\u00f6sa arbetet just nu och ompr\u00f6va det igen om sex m\u00e5nader.&nbsp;<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">I sin dagliga kontakt med Almegas medlemmar m\u00e4rker Maria Morberg att m\u00e5nga \u00e4r angel\u00e4gna om att g\u00f6ra r\u00e4tt, n\u00e4r vi g\u00e5r mot en post-corona-v\u00e4rld, men hon menar att det \u00e4r viktigt att se fr\u00e5gan som en flexibel process:<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">\u2013 Jag f\u00e5r till exempel ofta fr\u00e5gan om var gr\u00e4nsen g\u00e5r f\u00f6r arbetsgivarens ansvar f\u00f6r arbetsmilj\u00f6n i hemmet, men egentligen tycker jag att fr\u00e5gan borde omformuleras. F\u00f6r det g\u00e5r inte att s\u00e4tta en absolut gr\u00e4ns, eller s\u00e4ga exakt vilka saker som kan kr\u00e4vas att en arbetsgivare tillhandah\u00e5ller. Ist\u00e4llet tycker jag att man kan st\u00e4lla fr\u00e5gan vad medarbetaren beh\u00f6ver f\u00f6r att klara av sitt uppdrag, b\u00e5de f\u00f6r stunden och mer l\u00e5ngsiktigt?<\/span><span data-ccp-props=\"{&quot;335559740&quot;:360}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">Den situationsanpassade lyh\u00f6rdheten g\u00e4ller ocks\u00e5 ledarskapsfr\u00e5gor, menar Maria Morberg.
