Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<p><strong>AD 2021 23<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let var om arbetsgivaren brutit mot en best\u00e4mmelse i sitt kollektivavtal genom att inte l\u00e4mna ut omaskerade kopior p\u00e5 anst\u00e4llningsbevis till det kollektivavtalsb\u00e4rande fackf\u00f6rbundet.<\/p>\n<p>Best\u00e4mmelsen i kollektivavtalet angav att \u201d[d]en lokala fackliga organisationen ska erh\u00e5lla en kopia av anst\u00e4llningsbevis avseende anst\u00e4llningar d\u00e4r anst\u00e4llningstiden \u00f6verstiger en m\u00e5nad.\u201d Bolaget hade l\u00e4mnat kopior p\u00e5 anst\u00e4llningsbevis med maskerade personuppgifter om bl a namn och personnummer.<\/p>\n<p>Parterna var i f\u00f6rsta hand oense om kollektivavtalsbest\u00e4mmelsen innebar en skyldighet f\u00f6r arbetsgivaren att l\u00e4mna kopior utan att personuppgifter hade maskerats. Om best\u00e4mmelsen innebar en s\u00e5dan skyldighet var parterna oense om ett utl\u00e4mnande av kopior skulle strida mot dataskyddslagstiftningen p\u00e5 s\u00e5 s\u00e4tt att bolaget inte p\u00e5 ett skadest\u00e5ndsgrundande s\u00e4tt brutit mot kollektivavtalet.<\/p>\n<p>G\u00e4llande kollektivavtalets inneb\u00f6rd fann Arbetsdomstolen att det inte kunde utr\u00f6nas n\u00e5gon gemensam partsavsikt. Enligt Arbetsdomstolen var dock ordalydelsen klar och tydlig. Med kopia kunde inte parterna ha avsett annat \u00e4n en of\u00f6rvanskad avbild av anst\u00e4llningsbeviset i original. Arbetsgivaren var s\u00e5ledes skyldig att l\u00e4mna omaskerade kopior till den lokala fackf\u00f6reningen enligt kollektivavtalet.<\/p>\n<p>Arbetsdomstolen konstaterade inledningsvis att personuppgifter enligt dataskyddsf\u00f6rordningen f\u00e5r behandlas f\u00f6r att fullg\u00f6ra en r\u00e4ttslig f\u00f6rpliktelse som \u00e5vilar den personuppgiftsansvarige. Enligt dataskyddslagen kan en s\u00e5dan r\u00e4ttslig f\u00f6rpliktelse f\u00f6lja av kollektivavtal. Enligt Arbetsdomstolen var ordalydelsen av kollektivavtalsbest\u00e4mmelsen tillr\u00e4ckligt klar och tydlig f\u00f6r att grunda en r\u00e4ttslig f\u00f6rpliktelse i dataskyddslagstiftningens mening. Eftersom en omaskerad kopia av ett anst\u00e4llningsbevis ovillkorligen m\u00e5ste inneh\u00e5lla personuppgifter om arbetstagaren, var det enligt Arbetsdomstolen tydligt att f\u00f6rpliktelsen innefattade, eller snarare utgjordes av, utf\u00f6randet av en behandling av personuppgifter i form av ett utl\u00e4mnande till den lokala fackf\u00f6reningen. Bolaget hade s\u00e5ledes brutit mot kollektivavtalsbest\u00e4mmelsen.<\/p>\n<p><strong>AD 2021 24<\/strong><\/p>\n<p>AD hade att ta st\u00e4llning till ifall ett bolag haft laga sk\u00e4l f\u00f6r avsked av sin arbetstagare, S.S., en f\u00f6rs\u00e4ljningschef. Bolaget lade flertalet omst\u00e4ndigheter till grund f\u00f6r avskedet.<\/p>\n<p>Bolaget gjorde g\u00e4llande att S.S. regelm\u00e4ssigt hade st\u00e4llt ut fakturor f\u00f6r tidigt, vilket enligt arbetsgivaren medf\u00f6rt att int\u00e4kter redovisats f\u00f6r tidigt och att han d\u00e4rigenom handlat i strid med bolagets rutiner och god redovisningssed. AD fann att det inte hade funnits n\u00e5gra skriftliga rutiner om n\u00e4r fakturor skulle st\u00e4llas ut. AD menade att det inte fanns st\u00f6d f\u00f6r att anse att S.S. generellt skulle ha fakturerat tidigare \u00e4n vad som varit f\u00f6renligt med god redovisningssed. Inte heller ans\u00e5gs det visat att S.S. generellt avvikit fr\u00e5n n\u00e5gra instruktioner som han hade f\u00e5tt om hur fakturering skulle ske.<\/p>\n<p>Till grund f\u00f6r avskedet gjorde bolaget \u00e4ven g\u00e4llande att S.S. p\u00e5 ett felaktigt s\u00e4tt hade st\u00e4llt ut ett stort antal fakturor som inte blivit betalade, vilket syftade till att p\u00e5 ett felaktigt s\u00e4tt h\u00f6ja bolagets redovisade resultat. AD gjorde bed\u00f6mningen att bevisningen om att S.S. st\u00e4llt ut ett stort antal fakturor till ett v\u00e4rde i storleksordningen 10 miljoner kronor var s\u00e5 svag och oprecis att den inte var m\u00f6jlig f\u00f6r motparten att bem\u00f6ta eller f\u00f6r domstolen att bed\u00f6ma. Uppgiften kunde d\u00e4rf\u00f6r inte l\u00e4ggas till grund f\u00f6r pr\u00f6vning av fr\u00e5gan om laga sk\u00e4l f\u00f6r avsked. Inte heller p\u00e5st\u00e5endet om att f\u00f6rs\u00e4ljningschefens syfte varit att felaktigt h\u00f6ja bolagets redovisade resultat, som baserades p\u00e5 andrahandsuppgifter fr\u00e5n en avliden f\u00f6rs\u00e4ljningsassistent, fann AD visat.<\/p>\n<p>Bolagets inv\u00e4ndning om att S.S. registrerat f\u00f6rs\u00e4ljningar som inte \u00e4gt rum och \u00e5sidosatt grundl\u00e4ggande redovisningsrutiner vid fem aff\u00e4rer befanns i huvudsak inte styrkta. Inte heller fann AD att S.S. hade agerat v\u00e5rdsl\u00f6st och illojalt vid hanteringen av bolagets maskiner. Att det i stor utstr\u00e4ckning hade saknats dokumentation f\u00f6r att kontrollera var maskinerna befunnit sig kunde enligt AD inte l\u00e4ggas S.S. till last sedan det saknats fungerande rutiner f\u00f6r dokumentation och att S.S. n\u00e4rmaste chef varit fullt inf\u00f6rst\u00e5dd med hur dokumentationen sk\u00f6ttes.<\/p>\n<p>Slutligen menade bolaget att S.S. underl\u00e5tit att dela med sig av f\u00f6rs\u00e4ljningsrapporter till s\u00e4ljare. S.S. anv\u00e4nde sig inte av de m\u00f6jligheter som bolagets aff\u00e4rssystem gav att dela med sig till s\u00e4ljarna av regelbundna s\u00e4ljrapporter, med f\u00f6rklaringen att aff\u00e4rssystemets redovisning var r\u00f6rig, och att han d\u00e4rf\u00f6r manuellt l\u00e4t uppr\u00e4tta f\u00f6rs\u00e4ljningsrapporter som l\u00e4mnades till s\u00e4ljarna. Bolagets tidigare VD hade varit fullt inf\u00f6rst\u00e5dd med det och inte inv\u00e4nt mot hur S.S. informerade s\u00e4ljarna om f\u00f6rs\u00e4ljningsresultatet. Den nya VD:n uppmanade S.S. att g\u00f6ra p\u00e5 r\u00e4tt s\u00e4tt. AD menade dock att det inte framgick i hur n\u00e4ra anslutning till avst\u00e4ngningen S.S. fick uppmaningen eller hur hans arbetssituation s\u00e5g ut vid tillf\u00e4llet av uppmaningen. Sammantaget ans\u00e5g d\u00e4rf\u00f6r domstolen att agerandet i detta avseende inte utgjorde sk\u00e4l att skilja S.S. fr\u00e5n anst\u00e4llningen.<\/p>\n<p>Eftersom de omst\u00e4ndigheter bolaget lagt till grund f\u00f6r avskedet inte befanns styrkta, kom AD fram till bed\u00f6mningen att bolaget inte hade haft laga sk\u00e4l f\u00f6r avsked eller ens saklig grund f\u00f6r upps\u00e4gning.<\/p>\n<p><a href=\"http:\/\/www.arbetsdomstolen.se\/pages\/page.asp?lngID=4&amp;lngLangID=1&amp;Year=2020\" target=\"_blank\" rel=\"noopener noreferrer\">L\u00e4s mer om domarna p\u00e5 Arbetsdomstolens hemsida.<\/a>\n","protected":false},"excerpt":{"rendered":"<p>H\u00e4r publicerar vi snabba, korta kommentarer av de viktigaste domarna under veckan i Arbetsdomstolen.
