Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<p><strong>AD 2020 nr 69<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let g\u00e4llde dels om ett fackf\u00f6rbunds skadest\u00e5ndsyrkande f\u00f6r f\u00f6rhandlingsv\u00e4gran skulle avvisas p\u00e5 den grunden att parterna inte hade tvistef\u00f6rhandlat den fr\u00e5gan innan talan v\u00e4cktes. Med h\u00e4nvisning till sin praxis konstaterade Arbetsdomstolen att det inte finns n\u00e5got s\u00e5dant krav varf\u00f6r talan i den delen inte skulle avvisas.<\/p>\n<p>Arbetsgivaren hade sagt upp arbetstagarorganisationens medlem p\u00e5 grund av personliga sk\u00e4l. Organisationen gjorde g\u00e4llande att arbetsgivaren hade f\u00f6rhandlingsv\u00e4grat genom att inte ha inst\u00e4llt sig till f\u00f6rhandling eller medverkat till att f\u00f6rhandling kom till st\u00e5nd. I m\u00e5let var ostridigt att n\u00e5gon f\u00f6rhandling inte hade \u00e4gt rum.<\/p>\n<p>Organisationen hade via e-post beg\u00e4rt tvistef\u00f6rhandling enligt 10 \u00a7 MBL och angivit att den skulle ske snarast, dock senast onsdagen den 9 juli 2019. Vidare angavs att, f\u00f6r det fall arbetsgivaren \u00f6nskade tidigarel\u00e4gga f\u00f6rhandlingen, skulle detta meddelas senast den 3 juli.<\/p>\n<p>Av utredningen framgick att arbetsgivaren hade l\u00e4mnat f\u00f6rslag p\u00e5 andra f\u00f6rhandlingstider inom f\u00f6reskriven tid. Organisationen gjorde g\u00e4llande att den p\u00e5 grund av tekniska problem med sin e-post inte mottog arbetsgivarens meddelande f\u00f6rr\u00e4n den 8 juli. Organisationen gjorde g\u00e4llande att den d\u00e4refter i e-post uppmanat arbetsgivaren att f\u00f6resl\u00e5 nya f\u00f6rhandlingstider om bolaget ville \u00e4ndra den f\u00f6reslagna tiden den 9 juli.<\/p>\n<p>Arbetsdomstolen fann inte utrett att organisationen hade skickat det andra e-postmeddelandet, och fann d\u00e4rmed inte heller utrett att arbetsgivaren mottagit meddelandet. Arbetsgivaren befanns s\u00e5ledes inte haft anledning att vara antr\u00e4ffbar p\u00e5 den f\u00f6reslagna f\u00f6rhandlingstiden den 9 juli och hade s\u00e5ledes inte gjort sig skyldig till f\u00f6rhandlingsv\u00e4gran. Det hade inte f\u00f6relegat n\u00e5got hinder f\u00f6r organisationen att f\u00e5 till st\u00e5nd en tvistef\u00f6rhandling. F\u00f6rhandlingskravet enligt arbetstvistlagen befanns d\u00e4rmed inte uppfyllt vad avser upps\u00e4gningen varvid organisationens ogiltighets- och skadest\u00e5ndstalan avvisades.<\/p>\n<p><strong>AD 2020 nr 70<\/strong><\/p>\n<p>Huvudfr\u00e5gan i m\u00e5let var om arbetstagaren, genom en \u00f6verenskommelse om att anst\u00e4llningen avslutades p\u00e5 grund av arbetsbrist, avtalat bort sin r\u00e4tt till semesterers\u00e4ttning.<\/p>\n<p>Arbetsdomstolen redogjorde f\u00f6r r\u00e4ttsl\u00e4get vad avser semesterf\u00f6rm\u00e5ner, att semesterlagen i princip \u00e4r tvingande till arbetstagarens f\u00f6rm\u00e5n men att arbetstagaren inte \u00e4r f\u00f6rhindrad att efter anst\u00e4llningstidens utg\u00e5ng med bindande verkan avst\u00e5 sin r\u00e4tt genom en \u00f6verenskommelse. Det kr\u00e4vs dock att arbetstagaren verkligen har avsett att avst\u00e5 fr\u00e5n s\u00e5dana r\u00e4ttigheter eller i vart fall att omst\u00e4ndigheterna har varit s\u00e5dana att arbetsgivaren haft fog att anta att arbetstagaren hade s\u00e5dan avsikt.<\/p>\n<p>I \u00f6verenskommelsen angavs att samtliga mellanhavanden mellan parterna var slutligt reglerade och att ingendera parten hade n\u00e5got ytterligare att kr\u00e4va av den andre av vad slag det vara m\u00e5nde. Arbetsdomstolen fann utrett att \u00f6verenskommelsen hade formulerats av arbetsgivaren, att arbetstagaren, utan att tidigare ha sett \u00f6verenskommelsen, hade skrivit under den efter att arbetsgivaren hade \u00e5kt hem till arbetstagaren p\u00e5 kv\u00e4llen. Semesterers\u00e4ttning hade inte omn\u00e4mnts vid m\u00f6tet. \u00a0Dessa omst\u00e4ndigheter talade f\u00f6r att arbetstagaren inte avsett avst\u00e5 sin r\u00e4tt till semesterers\u00e4ttning utan n\u00e5gon som helst motprestation. Inte heller hade arbetsgivaren haft fog att utg\u00e5 fr\u00e5n att arbetstagaren haft s\u00e5dan avsikt. Arbetsgivaren f\u00f6rpliktigades s\u00e5ledes att betala yrkad semesterers\u00e4ttning.
