Om arbetsgivaren och arbetstagaren har olika uppfattning i en l\u00f6ne- eller ers\u00e4ttningsfr\u00e5ga och den anst\u00e4lldes uppfattning st\u00f6ds av en facklig organisation, kan det uppst\u00e5 en s k betalningstvist enligt 35 \u00a7 MBL. Det inneb\u00e4r att du som arbetsgivare m\u00e5ste agera snabbt f\u00f6r att undvika att tvingas betala ut ett belopp som du anser \u00e4r felaktigt. Vi vill d\u00e4rf\u00f6r informera om vad reglerna i MBL inneb\u00e4r och vad du som arbetsgivare m\u00e5ste g\u00f6ra.<\/p>\n<p>Betalningstvist, ibland anv\u00e4nds ocks\u00e5 uttrycket l\u00f6netvist, uppkommer n\u00e4r facklig organisation bunden av samma kollektivavtal som arbetsgivaren, framf\u00f6r krav p\u00e5 ers\u00e4ttning eller betalning f\u00f6r en medlems r\u00e4kning till arbetsgivaren och arbetsgivaren avvisar kravet d\u00e4rf\u00f6r att arbetsgivaren anser att arbetstagaren inte har r\u00e4tt till beloppet. Kravet beh\u00f6ver inte vara framf\u00f6rt vid en f\u00f6rhandling utan kan framf\u00f6ras av den fackliga organisationen n\u00e4r som helst.<\/p>\n<p><strong>R\u00e4ttsliga f\u00f6ruts\u00e4ttningar enligt 35 \u00a7 MBL <\/strong><\/p>\n<p>F\u00f6r att 35 \u00a7 MBL ska bli till\u00e4mplig kr\u00e4vs att arbetsgivaren och arbetstagarorganisationen \u00e4r bundna av samma kollektivavtal, att tvisten g\u00e4ller en medlem i den organisation som har kollektivavtal samt att tvisten \u00e4r en r\u00e4ttstvist och g\u00e4ller en tolkningsfr\u00e5ga om r\u00e4tt till ers\u00e4ttning enligt lag eller avtal (till exempel anst\u00e4llningsavtal eller kollektivavtal.) Beloppet som yrkas ska ha f\u00f6rfallit till betalning. Det f\u00e5r inte g\u00e4lla ett framtida krav p\u00e5 betalning. Summan ska ocks\u00e5 vara n\u00e5gorlunda preciserad eller i varje fall p\u00e5 ett enkelt s\u00e4tt g\u00e5 att r\u00e4kna ut.<\/p>\n<h2>Vad ska arbetsgivaren g\u00f6ra?<\/h2>\n<p><strong>Lokal f\u00f6rhandling omedelbart<\/strong><\/p>\n<p>F\u00f6r att slippa betala m\u00e5ste arbetsgivaren p\u00e5kalla lokal f\u00f6rhandling omedelbart n\u00e4r han eller hon tagit st\u00e4llning till den fackliga organisationens krav. D\u00e5 har en r\u00e4ttstvist om l\u00f6n eller ers\u00e4ttning uppkommit.<\/p>\n<p><a href=\"https:\/\/www.formable.se\/almega\/forhandlingsframstallan\" target=\"_blank\" rel=\"noopener noreferrer\">Mall f\u00f6r kallelse till lokal f\u00f6rhandling finns i Arbetsgivarguiden<\/a> (inloggning kr\u00e4vs)<\/p>\n<p><strong>Central f\u00f6rhandling inom 10 dagar<\/strong><\/p>\n<p>Om de lokala parterna inte kan l\u00f6sa tvisten i lokal f\u00f6rhandling m\u00e5ste en central f\u00f6rhandling beg\u00e4ras inom 10 dagar fr\u00e5n att den lokala f\u00f6rhandlingen avslutades. Det \u00e4r ditt f\u00f6rbund inom Almega som beg\u00e4r central f\u00f6rhandling hos den centrala fackliga organisationen.\u00a0 Kontakta genast ditt f\u00f6rbund inom Almega n\u00e4r den lokala f\u00f6rhandlingen avslutats.<\/p>\n<p><strong>V\u00e4cka talan i domstol inom 10 dagar<\/strong><\/p>\n<p>Om tvisten inte heller kan l\u00f6sas i central f\u00f6rhandling m\u00e5ste arbetsgivaren inom 10 dagar fr\u00e5n att den centrala f\u00f6rhandlingen avslutades v\u00e4cka talan i domstol, det vill s\u00e4ga l\u00e4mna in en st\u00e4mningsans\u00f6kan vid domstol. F\u00f6r f\u00f6retag som \u00e4r medlem hos f\u00f6rbund inom Almega sker detta till Arbetsdomstolen. S\u00e5dana domstolstvister hanteras normalt av Almega.<\/p>\n<p><strong>Missad frist \u2013 skyldighet betala<\/strong><\/p>\n<p>Om du som arbetsgivare inte f\u00f6ljer ovanst\u00e5ende korta tidsfrister uppst\u00e5r en r\u00e4ttslig skyldighet att betala det belopp som fackf\u00f6reningen kr\u00e4ver.
