{"id":29121,"date":"2020-03-27T16:40:57","date_gmt":"2020-03-27T15:40:57","guid":{"rendered":"https:\/\/www.almega.se\/?p=29121"},"modified":"2022-03-28T13:56:47","modified_gmt":"2022-03-28T11:56:47","slug":"andringar-och-fortydliganden-i-reglerna-vid-korttidsarbete","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2020\/03\/andringar-och-fortydliganden-i-reglerna-vid-korttidsarbete\/","title":{"rendered":"\u00c4ndringar och f\u00f6rtydliganden i reglerna om korttidsarbete"},"content":{"rendered":"\n<p class=\"intro\">Som vi tidigare informerat om har Regeringen inf\u00f6rt ett nytt system f\u00f6r st\u00f6d vid korttidsarbete. Lag\u00e4ndringarna tr\u00e4der i kraft den 7 april 2020 men de nya best\u00e4mmelserna ska till\u00e4mpas f\u00f6r tid fr\u00e5n och med den 16 mars 2020.<\/p>\n<p>Korttidsarbete inneb\u00e4r att en arbetstagare tillf\u00e4lligt g\u00e5r ner i arbetstid och l\u00f6n. Kostnaden delas av arbetstagare, arbetsgivare och staten. Till skillnad fr\u00e5n vad som g\u00e4llt enligt den tidigare lagen inneb\u00e4r det nya systemet att en arbetsgivare kan beviljas st\u00f6d med h\u00e4nsyn till f\u00f6rh\u00e5llandena hos den enskilda arbetsgivaren, det vill s\u00e4ga oberoende av det allm\u00e4nna konjunkturl\u00e4get och utan att regeringen meddelar f\u00f6reskrifter.<\/p>\n<h2>Offentligt finansierade verksamheter<\/h2>\n<p>Av lagen framg\u00e5r bland annat att arbetsgivare i fr\u00e5ga om verksamhet som huvudsakligen \u00e4r finansierad av allm\u00e4nna medel, och d\u00e4r det enligt en offentligr\u00e4ttslig reglering ankommer p\u00e5 det allm\u00e4nna att tillhandah\u00e5lla verksamheten, inte omfattas av lagen.<\/p>\n<p>Tillv\u00e4xtverket har meddelat att med stor sannolikhet kommer vissa offentligt finansierade verksamheter trots detta att omfattas under perioden den 16 mars 2020 till och med den 31 december 2020.<\/p>\n<p>Vi har dock \u00e4nnu inte f\u00e5tt klart besked om vissa offentligt finansierade verksamheter ska komma att omfattas och i s\u00e5 fall vilka verksamheter som avses.<\/p>\n<h2>Bemanningsf\u00f6retag omfattas av reglerna om st\u00f6d<\/h2>\n<p>Enligt reglerna ska vissa f\u00f6ruts\u00e4ttningar vara uppfyllda f\u00f6r att st\u00f6d ska l\u00e4mnas.<\/p>\n<p>En f\u00f6ruts\u00e4ttning \u00e4r att de ekonomiska sv\u00e5righeterna inte rimligen hade kunnat f\u00f6rutses eller undvikas.<\/p>\n<p>Av lagens f\u00f6rarbeten framg\u00e5r att st\u00f6d inte kan erh\u00e5llas av arbetsgivare vars verksamhet syftar till att m\u00f6ta andra arbetsgivares tillf\u00e4lliga och kortsiktiga behov av arbetskraft. Stora och pl\u00f6tsliga fall i efterfr\u00e5gan p\u00e5 arbetskraft anses f\u00f6r s\u00e5dana arbetsgivare inte vara of\u00f6rutsedda. Tillv\u00e4xtverket har nu meddelat att bemanningsf\u00f6retag, oavsett denna skrivning, omfattas av m\u00f6jligheten att s\u00f6ka st\u00f6d under perioden 16 mars till och med den 31 december 2020.<\/p>\n<h2>\u00c4ven konsulter och inhyrd personal kan vara verksamhetskritiska<\/h2>\n<p>En annan f\u00f6ruts\u00e4ttning \u00e4r att arbetsgivaren har anv\u00e4nt sig av andra tillg\u00e4ngliga \u00e5tg\u00e4rder f\u00f6r att minska kostnaden f\u00f6r arbetskraft.<\/p>\n<p>S\u00e5dana \u00e5tg\u00e4rder kan handla om att genomf\u00f6ra f\u00f6r\u00e4ndringar i skiftl\u00e4ggningen samt upps\u00e4gning av personal som inte \u00e4r tillsvidareanst\u00e4lld och som inte bed\u00f6ms vara verksamhetskritisk. Tillv\u00e4xtverket har nu f\u00f6rtydligat att i bed\u00f6mningen ska arbetsgivaren ta h\u00e4nsyn till den anst\u00e4lldes roll och funktion i verksamheten. \u00c4ven konsulter och inhyrd personal kan vara verksamhetskritiska och det finns d\u00e4rf\u00f6r inget generellt krav p\u00e5 att s\u00e4ga upp konsulter och inhyrd personal f\u00f6r att ha r\u00e4tt till st\u00f6d. Bed\u00f6mningen f\u00e5r g\u00f6ras i varje enskilt fall utifr\u00e5n f\u00f6rh\u00e5llandena hos den aktuella arbetsgivaren.<\/p>\n<h2>Aktieutdelningar kan \u00e4ventyra st\u00f6d<\/h2>\n<p>Enligt reglerna om korttidsarbete \u00e4r en f\u00f6ruts\u00e4ttning f\u00f6r st\u00f6d att arbetsgivaren har f\u00e5tt tillf\u00e4lliga och allvarliga ekonomiska sv\u00e5righeter.<\/p>\n<p>Tillv\u00e4xtverket har framh\u00e5llit att de \u00e4r av uppfattningen att det \u00e4r ol\u00e4mpligt att f\u00f6retag g\u00f6r stora aktieutdelningar och samtidigt tar del av det statliga st\u00f6det f\u00f6r korttidsarbete. Ser Tillv\u00e4xtverket att ett f\u00f6retag som f\u00e5tt st\u00f6det agerar p\u00e5 ett s\u00e4tt som visar att f\u00f6retaget inte befinner sig i ett sv\u00e5rt ekonomiskt l\u00e4ge har Tillv\u00e4xtverket p\u00e5pekat att de har m\u00f6jlighet att reglera st\u00f6det vid avst\u00e4mningen som sker efter att st\u00f6det beviljats, det vill s\u00e4ga d\u00e5 finns en risk f\u00f6r beslut om \u00e5terbetalning av st\u00f6d.<\/p>\n<h2>Familjemedlemmar och \u00e4gare omfattas<\/h2>\n<p>Av reglerna framg\u00e5r vidare att st\u00f6d bland annat inte l\u00e4mnas f\u00f6r arbetstagare som tillh\u00f6r arbetsgivarens familj.<\/p>\n<p>Tillv\u00e4xtverket har nu gjort tolkningen att de enda arbetsgivare som kan anses ha en familj \u00e4r enskilda n\u00e4ringsidkare eftersom endast dessa \u00e4r fysiska personer. Tolkningen inneb\u00e4r att \u00e4ven anst\u00e4llda \u00e4gare och anst\u00e4llda som tillh\u00f6r dennes familj kan omfattas av reglerna om st\u00f6d vid korttidsarbete, med undantag f\u00f6r f\u00f6retagsformen enskild firma. En enskild firmas eventuella andra anst\u00e4llda kan dock omfattas.<\/p>\n<h2>St\u00f6d l\u00e4mnas \u00e4ven f\u00f6r upps\u00e4gningstid<\/h2>\n<p>Lagen om st\u00f6d vid korttidsarbete \u00e4r nu justerad s\u00e5 att st\u00f6d \u00e4ven l\u00e4mnas f\u00f6r korttidsarbete som \u00e4r h\u00e4nf\u00f6rligt till en arbetstagares upps\u00e4gningstid. Detta g\u00e4ller f\u00f6r perioden 16 mars till och med den 31 december 2020.<\/p>\n<h2>Ingen skyldighet att l\u00e4mna varsel till Arbetsf\u00f6rmedlingen inf\u00f6r korttidsarbete<\/h2>\n<p>Arbetsf\u00f6rmedlingen har nu meddelat att de delar Almegas uppfattning att arbetsgivare <u>inte<\/u> \u00e4r skyldiga att varsla om permittering enligt 3 \u00a7 fr\u00e4mjandelagen, om arbetsgivaren anv\u00e4nder det nya systemet om korttidsarbete.
