{"id":27358,"date":"2020-01-30T12:55:11","date_gmt":"2020-01-30T11:55:11","guid":{"rendered":"https:\/\/www.almega.se\/?p=27358"},"modified":"2022-03-28T11:51:12","modified_gmt":"2022-03-28T09:51:12","slug":"nytt-lakarintyg-for-bedomning-av-ratt-till-sjuklon-m-m","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2020\/01\/nytt-lakarintyg-for-bedomning-av-ratt-till-sjuklon-m-m\/","title":{"rendered":"Nytt l\u00e4karintyg f\u00f6r bed\u00f6mning av r\u00e4tt till sjukl\u00f6n m m"},"content":{"rendered":"\n<p class=\"intro\">Med anledning av att det allt oftare utf\u00e4rdas bristf\u00e4lliga sjukl\u00f6neintyg har Sveriges Kommuner och Regioner (SKR) i samarbete med bl a Svenskt N\u00e4ringsliv tagit fram ett nytt sjukl\u00f6neintyg; \u201dL\u00e4karintyg om arbetsf\u00f6rm\u00e5ga \u2013 sjukl\u00f6neperioden (dag 1-14 sjukperioden)\u201d.<\/p>\n<p>Det nya l\u00e4karintyget kommer att introduceras successivt inom h\u00e4lso- och sjukv\u00e5rden. Det \u00e4r d\u00e4rf\u00f6r viktigt att du som arbetsgivare k\u00e4nner till det nya l\u00e4karintyget. Vi informerar n\u00e4rmare nedan om n\u00e4r det nya sjukl\u00f6neintyget b\u00f6rjar g\u00e4lla, n\u00e4r det ska anv\u00e4ndas, vad du som arbetsgivare ska g\u00f6ra om du f\u00e5r ett bristf\u00e4lligt intyg, att s k \u201dminimala intyg\u201d avskaffas m m.<\/p>\n<p><strong>Syftet med nytt sjukl\u00f6neintyg fr\u00e5n dag 1 \u2013 14 i sjukperioden<\/strong><\/p>\n<p>Syftet med det nya sjukl\u00f6neintyget \u00e4r att s\u00e4kerst\u00e4lla att sjukl\u00f6nelagens krav uppfylls, s\u00e5 att den anst\u00e4llde med intyget kan styrka nedsatt arbetsf\u00f6rm\u00e5ga p\u00e5 grund av sjukdom. Intyget \u00e4r ett beslutsunderlag f\u00f6r arbetsgivaren f\u00f6r st\u00e4llningstagande om arbetstagarens r\u00e4tt till sjukl\u00f6n och sjukfr\u00e5nvaro. Det utg\u00f6r \u00e4ven underlag f\u00f6r att klarl\u00e4gga arbetstagarens behov av tidiga rehabiliteringsinsatser. Arbetstagaren kan v\u00e4lja att d\u00f6lja sin sjukdomsdiagnos (8 \u00a7 sjukl\u00f6nelagen).<\/p>\n<p>Det nya sjukl\u00f6neintyget syftar \u00e4ven till att f\u00f6rb\u00e4ttra informationsfl\u00f6det mellan h\u00e4lso- och sjukv\u00e5rden, arbetstagaren och arbetsgivaren tidigt i sjukskrivnings- och rehabiliteringsprocessen.<\/p>\n<p>Sjukl\u00f6neintyget kan enligt sjukl\u00f6nelagen endast utf\u00e4rdas av l\u00e4kare eller tandl\u00e4kare.<\/p>\n<p><strong>N\u00e4r ska det nya sjukl\u00f6neintyget anv\u00e4ndas? <\/strong><\/p>\n<p>Sjukl\u00f6neintyget \u00e4r avsett att anv\u00e4ndas <strong>dag 1 \u2013 14 i sjukperioden<\/strong>. Det inneb\u00e4r att intyget ska anv\u00e4ndas n\u00e4r arbetstagaren fr\u00e5n och med <strong>dag \u00e5tta<\/strong> i sjukperioden ska styrka neds\u00e4ttning av arbetsf\u00f6rm\u00e5gan p\u00e5 grund av sjukdom genom intyg av l\u00e4kare eller tandl\u00e4kare f\u00f6r r\u00e4tt till sjukl\u00f6n fr\u00e5n arbetsgivaren (8 \u00a7 sjukl\u00f6nelagen).<\/p>\n<p><u>F\u00f6rstadagsintyg<\/u><\/p>\n<p>Det inneb\u00e4r ocks\u00e5 att intyget \u00e4r avsett att anv\u00e4ndas i de situationer d\u00e5 arbetsgivaren av arbetstagaren beg\u00e4rt intyg som styrker neds\u00e4ttning av arbetsf\u00f6rm\u00e5gan tidigare \u00e4n dag \u00e5tta \u2013 s\u00e5 kallade <strong>f\u00f6rstadagsintyg<\/strong> (10a \u00a7 sjukl\u00f6nelagen eller kollektivavtal).<\/p>\n<p><u>\u00c5terinsjuknande inom fem dagar<\/u><\/p>\n<p>Vid \u00e5terinsjuknande inom fem dagar efter att en tidigare sjukperiod avslutats, ska sjukl\u00f6neperioden endast omfatta s\u00e5 m\u00e5nga dagar att den tillsammans med den tidigare sjukperioden \u00e4r 14 dagar (7 \u00a7 sjukl\u00f6nelagen). Inneb\u00e4r \u00e5terinsjuknandet att sjukperioden \u00f6verstiger 14 dagar, bed\u00f6mer F\u00f6rs\u00e4kringskassan r\u00e4tten till sjukpenning efter dag 14 i sjukperioden, allts\u00e5 fr\u00e5n dag 15 i sjukperioden. Vid s\u00e5dant \u00e5terinsjuknande b\u00f6r l\u00e4karen ist\u00e4llet anv\u00e4nda F\u00f6rs\u00e4kringskassans L\u00e4karintyg f\u00f6r sjukpenning.<\/p>\n<p>\u00c4ven d\u00e5 l\u00e4karen initialt bed\u00f6mer att sjukfallet kommer att p\u00e5g\u00e5 l\u00e4ngre \u00e4n dag 14 i sjukperioden, b\u00f6r l\u00e4karen anv\u00e4nda F\u00f6rs\u00e4kringskassans L\u00e4karintyg f\u00f6r sjukpenning. Detta eftersom F\u00f6rs\u00e4kringskassan kommer att bed\u00f6ma r\u00e4tten till sjukpenning efter dag 14 i sjukperioden.<\/p>\n<p><strong>Blankt eller bristf\u00e4lligt l\u00e4karintyg? <\/strong><\/p>\n<p>\u00c4ven om det inte finns n\u00e5got formkrav f\u00f6r hur ett sjukl\u00f6neintyg ska se ut, s\u00e5 rekommenderar SKR alla v\u00e5rdenheter att anv\u00e4nda det nya sjukl\u00f6neintyget. Det nya intyget \u00e4r anpassat till Socialstyrelsens intygsf\u00f6reskrift (HSLF-FS 2018:54).<\/p>\n<p><a href=\"https:\/\/skr.se\/download\/18.4bd09c9916ed5ae6590baf45\/1576057432695\/PDF-formular_intyg_sjukloneperioden.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">S\u00e5 h\u00e4r ser det nya intyget ut<\/a><\/p>\n<p>L\u00e4mnar arbetstagaren ett sjukl\u00f6neintyg till sin arbetsgivare som inte styrker arbetsf\u00f6rm\u00e5gans neds\u00e4ttning p\u00e5 grund av sjukdom, exempelvis f\u00f6r att det \u00e4r bristf\u00e4lligt eller otydligt, kan arbetsgivaren uppmana arbetstagare att komplettera intyget med n\u00f6dv\u00e4ndig information, f\u00f6rslagsvis med det nya sjukl\u00f6neintyget. Det \u00e4r arbetstagaren som \u00e4r skyldig att inkomma med ett s\u00e5 tydligt l\u00e4karintyg att r\u00e4tten till sjukl\u00f6n m m kan bed\u00f6mas av arbetsgivaren.<\/p>\n<p>F\u00f6r att arbetsgivare ska kunna bed\u00f6ma den anst\u00e4lldes arbetsf\u00f6rm\u00e5ga i samband med sjukdom och uppfylla sitt ansvar f\u00f6r arbetsplatsinriktad rehabilitering, kr\u00e4vs information i l\u00e4karintyget om p\u00e5 vilket s\u00e4tt sjukdomen s\u00e4tter ner arbetstagarens arbetsf\u00f6rm\u00e5ga i f\u00f6rh\u00e5llande till aktuella arbetsuppgifter och v\u00e4gledning i hur arbetsf\u00f6rm\u00e5ga kan tas tillvara. Informationen beh\u00f6vs ocks\u00e5 f\u00f6r arbetsgivarens bed\u00f6mning av r\u00e4tten till fr\u00e5nvaro, sjukl\u00f6n och eventuellt sjukpenningtill\u00e4gg.<\/p>\n<p><strong>N\u00e4r b\u00f6rjar det nya sjukl\u00f6neintyget att g\u00e4lla? <\/strong><\/p>\n<p>Det nya sjukl\u00f6neintyget introduceras successivt inom h\u00e4lso- och sjukv\u00e5rden fr\u00e5n och med den <strong>3 december 2019<\/strong>. F\u00f6r de v\u00e5rdenheter som inte anv\u00e4nder intygsapplikationen Webcert kan intyget laddas ner i PDF-format fr\u00e5n SKR:s webbplats.<\/p>\n<p>Intyget kan inte skickas elektroniskt till arbetsgivaren fr\u00e5n h\u00e4lso- och sjukv\u00e5rden, utan arbetstagaren ansvarar sj\u00e4lv f\u00f6r att arbetsgivaren f\u00e5r intyget. Arbetstagaren kan n\u00e5 sina elektroniska intyg i e-tj\u00e4nsten Mina intyg.<\/p>\n<p><strong>Minimala sjukpenningintyg avskaffade <\/strong><\/p>\n<p>Den <strong>3 december 2019<\/strong> avskaffade SKR\/Inera m\u00f6jligheten f\u00f6r l\u00e4kare att omvandla ett \u201dL\u00e4karintyg f\u00f6r sjukpenning\u201d (FK7804) till ett s\u00e5 kallat minimalt intyg. Samtidigt avskaffades \u00e4ven m\u00f6jligheten f\u00f6r arbetstagaren att i Mina sidor omvandla ett utf\u00e4rdat L\u00e4karintyg f\u00f6r sjukpenning till ett minimalt intyg. De minimala intygen har inneburit att n\u00f6dv\u00e4ndig information i intyget har raderats, bland annat information om funktionsneds\u00e4ttning och aktivitetsbegr\u00e4nsning.<\/p>\n<p><strong>L\u00e4karintyg f\u00f6r sjukpenningtid<\/strong><\/p>\n<p>F\u00f6rs\u00e4kringskassan bed\u00f6mer efter dag 14 i sjukperioden arbetstagarens r\u00e4tt till sjukpenning och ska klarl\u00e4gga behov av rehabilitering. I sjukpenning\u00e4renden anv\u00e4nds F\u00f6rs\u00e4kringskassans blankett \u201dL\u00e4karintyg f\u00f6r sjukpenning\u201d (FK7804). Eftersom arbetstagaren i f\u00f6rh\u00e5llande till arbetsgivaren \u00e4ven under sjukpenningtid m\u00e5ste styrka sin nedsatta arbetsf\u00f6rm\u00e5ga och r\u00e4tt till fr\u00e5nvaro p\u00e5 grund av sjukdom med l\u00e4karintyg anv\u00e4nds detta intyg. Det inneb\u00e4r att h\u00e4lso- och sjukv\u00e5rden f\u00f6r sjukpenningtid endast beh\u00f6ver utf\u00e4rda ett intyg till patienten (arbetstagaren). Arbetstagaren l\u00e4mnar kopia p\u00e5 det utf\u00e4rdade intyget till sin arbetsgivare och kan d\u00e5 v\u00e4lja att d\u00f6lja sjukdomsdiagnos.<\/p>\n<p><strong>Ytterligare l\u00e4karintyg fr\u00e5n SKR f\u00f6r sjukpenningtid<\/strong><\/p>\n<p>I samband med att SKR avskaffat m\u00f6jligheten att omvandla F\u00f6rs\u00e4kringskassans L\u00e4karintyg f\u00f6r sjukpenning (FK7804) till ett minimalt intyg, valde SKR att lansera ytterligare ett intyg f\u00f6r sjukpenningtid; \u201dL\u00e4karintyg om arbetsf\u00f6rm\u00e5ga \u2013 arbetsgivaren (dag 15 och fram\u00e5t)\u201d med SKR:s logotyp. SKR;s avsikt \u00e4r att tv\u00e5 intyg f\u00f6r sjukpenningtid ska utf\u00e4rdas av l\u00e4karen till patienten. Informationen i F\u00f6rs\u00e4kringskassans intyg kan f\u00f6ras \u00f6ver digitalt till \u201darbetsgivarintyget\u201d, men ej vice versa. L\u00e4karen kan d\u00e4rut\u00f6ver v\u00e4lja att ta bort eller \u00e4ndra i den information som f\u00f6rts \u00f6ver till \u201darbetsgivarintyget\u201d innan detta intyg utf\u00e4rdas till patienten.<\/p>\n<p>Svenskt N\u00e4ringsliv st\u00e5r inte bakom inf\u00f6randet av att tv\u00e5 olika intyg utf\u00e4rdas till en och samma patient f\u00f6r samma tid. Det inneb\u00e4r on\u00f6dig belastning av v\u00e5rden. Det riskerar \u00e4ven inneb\u00e4ra att intygen inneh\u00e5ller olika information, vilket kan f\u00f6rsv\u00e5ra arbetsgivarens arbetsplatsinriktade rehabilitering och samverkan med F\u00f6rs\u00e4kringskassan. Det inneb\u00e4r \u00e4ven risk f\u00f6r bristf\u00e4lligt intyg till arbetsgivaren.<\/p>\n<p><strong>Bristf\u00e4lligt l\u00e4karintyg f\u00f6r sjukpenningtid? <\/strong><\/p>\n<p>L\u00e4mnar arbetstagaren ett intyg till sin arbetsgivare som inte styrker arbetsf\u00f6rm\u00e5gans neds\u00e4ttning p\u00e5 grund av sjukdom, kan arbetstagaren uppmanas att komplettera intyget med n\u00f6dv\u00e4ndig information. Detta kan exempelvis g\u00f6ras med kopia p\u00e5 F\u00f6rs\u00e4kringskassans L\u00e4karintyg f\u00f6r sjukpenning (FK7804).
