Medief\u00f6retagen och dess medlemsf\u00f6retag Hatten Education AB yrkade i domstolen att AD skulle fastst\u00e4lla att f\u00f6retaget hade f\u00f6rv\u00e4rvat r\u00e4tten fr\u00e5n illustrat\u00f6ren att f\u00f6rfoga \u00f6ver \u2013 inklusive r\u00e4tten att \u00e4ndra och vidarelicensiera \u2013 de upphovsr\u00e4ttsligt skyddade prestationer som uppkommit dels inom ramen f\u00f6r illustrat\u00f6rens anst\u00e4llningsf\u00f6rh\u00e5llande dels inom ramen f\u00f6r det uppdragsf\u00f6rh\u00e5llande illustrat\u00f6ren haft med Hatten.<\/p>\n\n<p>AD gick helt och h\u00e5llet p\u00e5 Medief\u00f6retagens och Hattens yrkanden. <a href=\"http:\/\/www.arbetsdomstolen.se\/upload\/pdf\/2019\/53-19.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Domen<\/a>, som f\u00f6r \u00f6vrigt \u00e4r mycket v\u00e4lskriven, var enh\u00e4llig och kan inte \u00f6verklagas.<\/p>\n\n\n\n<p>Domen r\u00f6r ett enskilt medlemsf\u00f6retag men \u00e4r principiellt viktig f\u00f6r alla f\u00f6retag som avtalar om upphovsr\u00e4ttsligt skyddat material med s\u00e5v\u00e4l anst\u00e4llda som uppdragstagare. Den ligger ocks\u00e5 i linje med tidigare liknande r\u00e4ttsfall n\u00e4r det g\u00e4ller \u00f6verg\u00e5ng av r\u00e4ttigheter. En slutsats \u00e4r naturligtvis att det alltid \u00e4r viktigt med skriftliga och tydliga avtal, men ocks\u00e5 att andra omst\u00e4ndigheter kan f\u00e5 betydelse, som exempelvis konkludent handlande.<\/p>\n\n\n\n<p>AD uttrycker det p\u00e5 f\u00f6ljande s\u00e4tt n\u00e4r det g\u00e4ller <strong>best\u00e4llningsuppdrag<\/strong>: \u201dVid best\u00e4llningsuppdrag m\u00e5ste det anses att best\u00e4llaren redan genom uppdragsavtalet har f\u00f6rv\u00e4rvat \u00e5tminstone viss r\u00e4tt till verket. Vilken n\u00e4rmare r\u00e4tt best\u00e4llaren har f\u00f6rv\u00e4rvat f\u00e5r avg\u00f6ras mot bakgrund av omst\u00e4ndigheterna i samband med uppdragsavtalets tillkomst och till\u00e4mpning samt parternas agerande.\u201d<\/p>\n\n\n\n<p>Faktorer som kan ha betydelse \u00e4r \u00e4ndam\u00e5let med avtalet, uppdragsavtalets specifika krav, arten av verk, betalningsformen, betalningens storlek, branschpraxis och parternas inst\u00e4llning.<\/p>\n\n\n\n<p>N\u00e4r det g\u00e4ller <strong>anst\u00e4llningsavtal<\/strong> har AD uttalat att, \u201dd\u00e5 inget uttryckligen avtalats genom anst\u00e4llningsavtalet, torde en \u00f6verg\u00e5ng av upphovsr\u00e4ttigheter till det som arbetstagaren presterat inom ramen f\u00f6r anst\u00e4llningen i vissa fall kunna \u00e4ga rum underf\u00f6rst\u00e5tt redan genom anst\u00e4llningsf\u00f6rh\u00e5llandets beskaffenhet.\u201d Ledning f\u00e5r d\u00e5 s\u00f6kas i anst\u00e4llningsf\u00f6rh\u00e5llandets art samt branschens allm\u00e4nna villkor och sedv\u00e4njor.
