Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<p><strong>AD 2019 nr 39<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let var om Polismyndigheten haft saklig grund att s\u00e4ga upp en polis. I m\u00e5let var tvistigt dels om Polismyndighetens beslut att inte l\u00e4ngre godk\u00e4nna polisen f\u00f6r s\u00e4kerhetsklassat arbete utgjorde saklig grund f\u00f6r upps\u00e4gning, dels, om s\u00e5 inte ans\u00e5gs vara fallet, om omst\u00e4ndigheterna till grund f\u00f6r s\u00e4kerhetsbeslutet utgjorde saklig grund f\u00f6r upps\u00e4gning. I m\u00e5let var ostridigt att n\u00e5gra omplaceringsm\u00f6jligheter till icke s\u00e4kerhetsklassat arbete inte fanns.<\/p>\n<p>Arbetsdomstolen redogjorde f\u00f6r best\u00e4mmelserna i s\u00e4kerhetsskyddslagen, bl a om att s\u00e4kerhetspr\u00f6vning f\u00e5r g\u00f6ras under p\u00e5g\u00e5ende anst\u00e4llning f\u00f6r att klarl\u00e4gga om personen kan antas vara lojal mot de intressen som skyddas i lagen och i \u00f6vrigt \u00e4r p\u00e5litlig ur s\u00e4kerhetssynpunkt. Ett beslut om att inte godk\u00e4nna en person f\u00f6r s\u00e4kerhetsklassat arbete f\u00e5r inte \u00f6verklagas.<\/p>\n<p>Arbetsdomstolen konstaterade att den myndighet som i detta fall hade fattat s\u00e4kerhetsbeslutet \u00e4ven var arbetsgivaren. Polismyndigheten gjorde inte g\u00e4llande att den skulle ha varit f\u00f6rhindrad att, inom ramen f\u00f6r upps\u00e4gningsprocessen, fatta ett annat beslut. Polismyndigheten var heller inte f\u00f6rhindrad att ange omst\u00e4ndigheterna som s\u00e4kerhetsbeslutet och upps\u00e4gningsbeslut grundats p\u00e5. Arbetsdomstolen kunde s\u00e5ledes g\u00f6ra en pr\u00f6vning i sak av de omst\u00e4ndigheter som legat till grund f\u00f6r upps\u00e4gningsbeslutet samt bed\u00f6ma de omst\u00e4ndigheter som arbetsgivaren \u00e5beropat som intr\u00e4ffat tiden efter att s\u00e4kerhetsbesluten fattades. Arbetsdomstolen bed\u00f6mde att en s\u00e5dan pr\u00f6vning innebar att kravet p\u00e5 domstolspr\u00f6vning enligt art. 6.1 Europakonventionen uppfylls.<\/p>\n<p>S\u00e4kerhetsbeslutet i sig bed\u00f6mdes inte kunna utg\u00f6ra saklig grund f\u00f6r upps\u00e4gning. Arbetsdomstolen konstaterade att utredningen visade att polisen hade haft en relation, blivit sambo och sedermera f\u00e5tt barn med en person som d\u00f6mts f\u00f6r allvarlig brottslighet s\u00e5som bl a grovt vapenbrott, st\u00f6ld och narkotikasmuggling. Vid ett tillf\u00e4lle ska personen ha stulit en annan polis tj\u00e4nstevapen. Polisens relation med personen bed\u00f6mdes av Arbetsdomstolen som en risk f\u00f6r att hon skulle kunna hamna i konflikt mellan hennes skyldigheter som polis och lojaliteten gentemot partnern.<\/p>\n<p>Domstolen fann inte styrkt att polisen hade pratat med sin partnern om den p\u00e5g\u00e5ende brottm\u00e5lsprocessen d\u00e5 denne satt frihetsber\u00f6vad. Polisen befanns dock ha agerat mycket ol\u00e4mpligt n\u00e4r hon l\u00e5tit partnern l\u00e5na hennes dator under frihetsber\u00f6vandet. I m\u00e5let var ostridigt att polisen f\u00e5tt en fullmakt fr\u00e5n partnern att ta del av alla f\u00f6rekommande uppgifter om honom hos Polismyndigheten och att hon genom denna bl a bett att f\u00e5 f\u00f6runders\u00f6kningsmaterial skickat till sin arbetsmejl. Arbetsdomstolen fann sammanfattningsvis att polisen hade varit djupt involverad i \u00e4rendet. Det befanns inte styrkt att polisen medvetet l\u00e4mnat oriktiga uppgifter till arbetsgivaren avseende n\u00e4r hon fick k\u00e4nnedom om partnerns narkotikamissbruk. I m\u00e5let var dock ostridigt att polisen l\u00e5tit partnern skriva sig hos henne f\u00f6r att underl\u00e4tta f\u00f6r honom att bli sl\u00e4ppt fr\u00e5n h\u00e4ktet och f\u00e5 ut\u00f6kad frig\u00e5ng.<\/p>\n<p>Arbetsdomstolen konstaterade att enbart en viss familjebildning inte utan lagligt st\u00f6d f\u00e5r leda till att en anst\u00e4llnings f\u00f6rloras. Polisens agerande f\u00f6r partnerns r\u00e4kning bed\u00f6mdes dock som klart ol\u00e4mpligt och otill\u00e5tet. F\u00f6r att f\u00f6rtroendet f\u00f6r henne som polis skulle ha kvarst\u00e5tt orubbat \u00e5l\u00e5g det henne att inta en neutral h\u00e5llning i brottm\u00e5lsprocessen och inte personligen engagera sig i partnerns fall. \u00c4ven om brottm\u00e5lsprocessen var \u00f6ver vid tidpunkten f\u00f6r Arbetsdomstolens bed\u00f6mning, fanns inte befogad anledning att anta att hon aldrig skulle \u00e5sidos\u00e4tta sina skyldigheter som polis till f\u00f6rm\u00e5n f\u00f6r partnern igen, mot bakgrund av att de valt att f\u00f6rdjupa sin relation ytterligare genom sambo- och f\u00f6r\u00e4ldraskap. Sammantaget befanns polisens agerande utg\u00f6ra en uppenbar risk f\u00f6r att allm\u00e4nhetens f\u00f6rtroende f\u00f6r henne som polis och f\u00f6r Polismyndigheten kunde p\u00e5verkas negativt, att hennes f\u00f6rm\u00e5ga att avh\u00e5lla sig fr\u00e5n ageranden som kunde riskera f\u00f6rtroendet kunde ifr\u00e5gas\u00e4ttas p\u00e5 s\u00e5dant s\u00e4tt att saklig grund f\u00f6r upps\u00e4gning f\u00f6rel\u00e5g. Att arbetsgivaren inte givit n\u00e5gon s.k. LAS-varning \u00e4ndrade inte den bed\u00f6mningen, sedan polisen haft bristande insikt om vad som \u00e5vilat henne som polis, och det enligt Arbetsdomstolen ligger i sakens natur att det inte \u00e5ligger en arbetsgivare att upplysa arbetstagare om detta f\u00f6rh\u00e5llande.
