Vidare har Svenskt N\u00e4ringsliv och PTK ing\u00e5tt avtal om f\u00f6r\u00e4ndringar i omst\u00e4llningsavtalet f\u00f6r tj\u00e4nstem\u00e4n. Avtalen inneb\u00e4r f\u00f6r 2019 bl.a. att f\u00f6retag som \u00e4r medlemmar i ett arbetsgivarf\u00f6rbund inom Svenskt N\u00e4ringsliv inte betalar n\u00e5gon premie alls till TRR (g\u00e4ller tj\u00e4nstem\u00e4n) och avgiften till TSL\/AGB (g\u00e4ller arbetare) s\u00e4nks till 0,0773 procent av l\u00f6nesumman.<\/p>\n<p>Det betyder en stor besparing under 2019. Dessutom har omst\u00e4llningsf\u00f6rs\u00e4kringen bl.a. ut\u00f6kats till att \u00e4ven kunna g\u00e4lla f\u00f6r den som blir uppsagd p.g.a. sjukdom. F\u00f6ruts\u00e4ttningen \u00e4r att tj\u00e4nstemannen accepterar upps\u00e4gningen. F\u00f6r\u00e4ndringen kommer att kunna underl\u00e4tta omst\u00e4llning vid sjukdom.<\/p>\n<p><em>Fora kommer troligtvis att faktura den tidigare premien (0,3 %) \u00e4ven p\u00e5 fakturan i februari. Denna avgift kommer i s\u00e5dant fall att krediteras p\u00e5 fakturan i april. <\/em><\/p>\n<h2><strong>Avtalet om omst\u00e4llningsf\u00f6rs\u00e4kring mellan Svenskt N\u00e4ringsliv och LO (g\u00e4ller arbetare)<\/strong><\/h2>\n<p>Svenskt N\u00e4ringsliv och LO har kommit \u00f6verens om dels en neds\u00e4ttning av avgiften till omst\u00e4llningsf\u00f6rs\u00e4kringen, b\u00e5de avseende AGB-f\u00f6rs\u00e4kringen och Trygghetsfonden TSL (TSL), dels en h\u00f6jning av beloppen i AGB-f\u00f6rs\u00e4kringen.<\/p>\n<h3>Neds\u00e4ttning av avgift till omst\u00e4llningsf\u00f6rs\u00e4kringen (AGB och TSL)<\/h3>\n<p>Bakgrunden \u00e4r en avtalad avgiftss\u00e4nkning f\u00f6r 2009 som aldrig blev av p\u00e5 grund av finanskrisen. AFA F\u00f6rs\u00e4kring har p\u00e5 uppdrag fr\u00e5n parterna gjort en f\u00f6rm\u00f6genhets- och premieanalys som visat att b\u00e5de AGB-f\u00f6rs\u00e4kringen och TSL-systemet klarar en neds\u00e4ttning av avgiften.<\/p>\n<p>Parterna har d\u00e4rf\u00f6r kommit \u00f6verens om att f\u00f6r 2019 ska avgiften till AGB-f\u00f6rs\u00e4kringen vara noll och avgiften till TSL ska vara 0,0773 procent. Den totala avgiften till omst\u00e4llningsf\u00f6rs\u00e4kringen f\u00f6r 2019 s\u00e4nks s\u00e5ledes fr\u00e5n 0,30 till 0,0773 procent p\u00e5 l\u00f6nesumman vilket \u00e4r en besparing p\u00e5 0,2227 procent. P\u00e5 avgiften 0,0773 tillkommer moms med 25 procent.<\/p>\n<h3>H\u00f6jning av beloppen i AGB<\/h3>\n<p>Inf\u00f6r varje nytt kalender\u00e5r g\u00f6rs en analys av storleken p\u00e5 beloppen i AGB-f\u00f6rs\u00e4kringen. Parterna har kommit \u00f6verens om att h\u00f6ja beloppen i AGB-f\u00f6rs\u00e4kringen med 2,5 procent. Grundbeloppet f\u00f6r 2019 blir 35\u00a0736 kr och till\u00e4ggsbeloppet 1\u00a0476 kr.<\/p>\n<h2><strong>Omst\u00e4llningsavtalet mellan Svenskt N\u00e4ringsliv och PTK (g\u00e4ller tj\u00e4nstem\u00e4n)<\/strong><\/h2>\n<p>Svenskt N\u00e4ringsliv och PTK har enats om en ordning f\u00f6r neds\u00e4ttning av avgiften, ett \u00e5terinf\u00f6rande av m\u00f6jligheten f\u00f6r TRR att st\u00f6tta tj\u00e4nstem\u00e4n som beh\u00f6ver n\u00e5got l\u00e4ngre studier f\u00f6r att f\u00e5 nytt arbete (TRR studieers\u00e4ttning) samt en m\u00f6jlighet f\u00f6r tj\u00e4nstem\u00e4n som sagts upp p\u00e5 grund av sjukdom att f\u00e5 TRR:s st\u00f6d i omst\u00e4llning till nytt arbete och erh\u00e5lla AGE-ers\u00e4ttning.<\/p>\n<h3>Neds\u00e4ttning av avgiften till TRR<\/h3>\n<p>Kapitalet i TRR har under senare \u00e5r successivt \u00f6kat betydligt, och uppg\u00e5r idag till ca 9,5 miljarder. Analyser av det framtida kapitalbehovet har gjorts av bl.a. AFA F\u00f6rs\u00e4kring och har lett till slutsatsen att TRR \u00e4r \u00f6verkapitaliserat.<\/p>\n<p>Avtalad neds\u00e4ttning av avgiften f\u00f6r medlemsf\u00f6retag uppg\u00e5r till 0,3 procent. Neds\u00e4ttningen av avgiften ska kvarst\u00e5 s\u00e5 l\u00e4nge TRR:s kapitalbehov \u00e4r betryggande uppfyllt. En bed\u00f6mning av kapitalbehovet ska g\u00f6ras \u00e5rligen och styrelsen ska med den bed\u00f6mningen som grund besluta om neds\u00e4ttning ska bibeh\u00e5llas eller inte. N\u00e4r konsolideringen befinner sig p\u00e5 r\u00e4tt niv\u00e5 upph\u00f6r s\u00e5ledes neds\u00e4ttningen av avgiften.<\/p>\n<p>Om neds\u00e4ttning upph\u00f6rt med h\u00e4nsyn till bed\u00f6mning av kapitalbehovet ska styrelsen p\u00e5 nytt fatta beslut om neds\u00e4ttning av avgift n\u00e4r TRR:s kapitalbehov \u00e4r betryggande uppfyllt.<\/p>\n<h3>TRR studieers\u00e4ttning<\/h3>\n<p>TRR har m\u00f6jlighet att besluta om TRR studieers\u00e4ttning vid l\u00e4ngre studier, minst motsvarande en termin och upp till fyra terminer. TRR studieers\u00e4ttning ska utg\u00f6ra en del av omst\u00e4llningsst\u00f6det och f\u00f6ljer i till\u00e4mpliga delar motsvarande regler.<\/p>\n<p>Beslut om TRR studieers\u00e4ttning kan fattas betr\u00e4ffande tj\u00e4nsteman som \u00e4r ber\u00e4ttigad till omst\u00e4llningsst\u00f6d och som fyllt 40 \u00e5r vid tidpunkten f\u00f6r studiestart.<\/p>\n<p>TRR ska pr\u00f6va dels tj\u00e4nstemannens behov av utbildning, dels om utbildningen \u00e4r s\u00e5dan att den kommer att \u00f6ka tj\u00e4nstemannens anst\u00e4llningsbarhet. Det \u00e4r TRR:s bed\u00f6mning som avg\u00f6r om TRR studieers\u00e4ttning ska beviljas eller inte.<\/p>\n<p>TRR studieers\u00e4ttning ska f\u00f6lja CSN:s modell f\u00f6r studiest\u00f6d med perioder som motsvarar termin och belopp per studievecka. TRR studieers\u00e4ttning ber\u00e4knas som om ber\u00f6rd tj\u00e4nsteman s\u00f6kt och beviljats studiest\u00f6d fr\u00e5n CSN (oavsett om tj\u00e4nstemannen tar ut eller har r\u00e4tt till studiest\u00f6d). Med studiest\u00f6d fr\u00e5n CSN avses h\u00e4r bidragsdel och grundl\u00e5n, dock inte omfattande s.k. till\u00e4ggsl\u00e5n. TRR studieers\u00e4ttning ska tillsammans med studiest\u00f6det upp till fribeloppsgr\u00e4nsen ge ekonomisk utfyllnad upp till 70 procent av tidigare l\u00f6n under termin 1 och 2, d\u00e4refter upp till 50 procent under termin 3 och 4.<\/p>\n<p>F\u00f6r tj\u00e4nstem\u00e4n som \u00e4r \u00e4ldre \u00e4n 57 \u00e5r saknas, enligt nu g\u00e4llande regler, r\u00e4tt till studiest\u00f6d fr\u00e5n CSN. F\u00f6r s\u00e5dan tj\u00e4nsteman ska TRR studieers\u00e4ttning best\u00e4mmas som om tj\u00e4nstemannen varit ber\u00e4ttigad till studiest\u00f6d fr\u00e5n CSN.<\/p>\n<p>TRR studieers\u00e4ttning p\u00e5verkar inte den r\u00e4tt till AGE som g\u00e4ller enligt Omst\u00e4llningsavtalet vid arbetsl\u00f6shet. TRR studieers\u00e4ttning f\u00e5r inte ber\u00e4knas p\u00e5 h\u00f6gre l\u00f6n \u00e4n AGE vid arbetsl\u00f6shet (1,4 x IBB\/m\u00e5nad).<\/p>\n<h3>Omst\u00e4llningsst\u00f6d och AGE f\u00f6r tj\u00e4nsteman som sagts upp p\u00e5 grund av sjukdom<\/h3>\n<p>Tj\u00e4nstem\u00e4n som sagts p\u00e5 grund av sjukdom kan omfattas av r\u00e4tt till TRR:s omst\u00e4llningsst\u00f6d och AGE om tj\u00e4nstemannen accepterat upps\u00e4gningen och med r\u00e4ttslig verkan f\u00f6rklarat att fr\u00e5gor om ogiltighet eller skadest\u00e5nd p\u00e5 grund av upps\u00e4gningen inte kommer att drivas i domstol. Om en arbetsgivare och en tj\u00e4nsteman kommit \u00f6verens om att anst\u00e4llningen ska upph\u00f6ra och grunden f\u00f6r det \u00e4r sjukdom ska motsvarande principer till\u00e4mpas som vid \u00f6verenskommelser om upph\u00f6rande p\u00e5 grund av arbetsbrist.<\/p>\n<p>F\u00f6rklaringen att tj\u00e4nstemannen med r\u00e4ttslig verkan har accepterat upps\u00e4gningen och avst\u00e5tt fr\u00e5n att angripa den ska l\u00e4mnas f\u00f6re det att tj\u00e4nstemannen eller den fackliga organisation tj\u00e4nstemannen tillh\u00f6r v\u00e4ckt talan om skadest\u00e5nd eller ogiltighet i saken<\/p>\n<h3>Regler f\u00f6r ikrafttr\u00e4dande och fakturering<\/h3>\n<p>Denna \u00f6verenskommelse till\u00e4mpas med verkan fr\u00e5n och med den 1 januari 2019. Neds\u00e4ttning av avgift inneb\u00e4r att medlemsf\u00f6retag inte betalar n\u00e5gon avgift fr\u00e5n och med 1 januari. F\u00f6r f\u00f6retag som betalar premie till TRR men inte \u00e4r medlemmar i Svenskt N\u00e4ringsliv uttas en avgift p\u00e5 0,4 procent av l\u00f6nesumman ist\u00e4llet f\u00f6r nuvarande 0,7 procent.<\/p>\n<p>TRR studieers\u00e4ttning kan beviljas fr\u00e5n och med den 1 januari 2019 f\u00f6r tj\u00e4nstem\u00e4n som \u00e4r i omst\u00e4llningsst\u00f6d och som uppfyller de villkor som anges i \u00f6verenskommelsen vid studiestart.<\/p>\n<p>F\u00f6r tj\u00e4nstem\u00e4n som sagts upp p\u00e5 grund av sjukdom eller tr\u00e4ffat \u00f6verenskommelse om anst\u00e4llningens upph\u00f6rande p\u00e5 den grunden till\u00e4mpas reglerna om tj\u00e4nstemannen efter den 1 januari 2019 accepterat att inte driva talan om ogiltighet eller skadest\u00e5nd p\u00e5 grund av upps\u00e4gningen eller tr\u00e4ffat nyss n\u00e4mnd \u00f6verenskommelse.<\/p>\n<h3>Ytterligare information<\/h3>\n<p>Ytterligare information kan l\u00e4mnas av din kontaktperson inom Almega.<\/p>\n<p>Ni kan \u00e4ven kontakta Finfa \u2013 F\u00f6rs\u00e4kringsinformation f\u00f6r arbetsgivare, tel 010-45 53\u00a0800.
