{"id":19167,"date":"2018-10-08T13:43:08","date_gmt":"2018-10-08T11:43:08","guid":{"rendered":"https:\/\/www.almega.se\/?p=19167"},"modified":"2022-03-28T11:07:11","modified_gmt":"2022-03-28T09:07:11","slug":"forlangd-uppsagningstid-vid-uppsagning-pa-grund-av-arbetsbrist-och-overgang-av-verksamhet","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2018\/10\/forlangd-uppsagningstid-vid-uppsagning-pa-grund-av-arbetsbrist-och-overgang-av-verksamhet\/","title":{"rendered":"F\u00f6rl\u00e4ngd upps\u00e4gningstid vid upps\u00e4gning p\u00e5 grund av arbets&shy;brist och \u00f6verg\u00e5ng av verksamhet"},"content":{"rendered":"\n<p class=\"intro\">R\u00e4ttsl\u00e4ge betr\u00e4ffande f\u00f6rl\u00e4ngd upps\u00e4gningstid vid \u00f6verg\u00e5ng av verksamhet klarlagt<\/p>\n<p class=\"intro\">Efter flera pr\u00f6vningar i Arbetsdomstolen och en pr\u00f6vning i EU-domstolen \u00e4r nu r\u00e4ttsl\u00e4get klarlagt vad g\u00e4ller bland annat ber\u00e4kningen av den sammanh\u00e4ngande anst\u00e4llningstiden om tio \u00e5r.<\/p>\n<p>Regeln i vissa kollektivavtal, som har sitt ursprung i 1994 \u00e5rs omst\u00e4llningsavtal mellan d\u00e5varande SAF och PTK, ska sammanfattningsvis tolkas p\u00e5 f\u00f6ljande vis.<\/p>\n<p><strong>Huvudregel<\/strong><\/p>\n<p>F\u00f6r att erh\u00e5lla f\u00f6rl\u00e4ngd upps\u00e4gningstid (6 + 6 m\u00e5nader) enligt kollektivavtalet fordras att anst\u00e4llningen varit <u>sammanh\u00e4ngande i minst tio \u00e5r hos den arbetsgivare som vidtar arbetsbristupps\u00e4gningen<\/u>.<\/p>\n<p>Vid ber\u00e4kning av anst\u00e4llningstid f\u00f6r t ex fastst\u00e4llande av turordning eller ber\u00e4kning av den vanliga upps\u00e4gningstiden g\u00e4ller d\u00e4remot 3 \u00a7 anst\u00e4llningsskyddslagen (LAS). Det \u00e4r d\u00e4rvid fr\u00e5ga om en ber\u00e4kning av <u>sammanlagd<\/u> anst\u00e4llningstid.<\/p>\n<p>N\u00e4r det g\u00e4ller regeln om f\u00f6rl\u00e4ngd upps\u00e4gningstid enligt tj\u00e4nstemannaavtalet sker s\u00e5ledes <u>inte<\/u> en ber\u00e4kning av <u>sammanlagd<\/u> anst\u00e4llningstid enligt 3 \u00a7 LAS.<\/p>\n<p>Det \u00e4r endast tiden i den innevarande <u>sammanh\u00e4ngande<\/u> anst\u00e4llningen som ska beaktas. N\u00e5gon r\u00e4tt att tillgodor\u00e4kna sig tidigare anst\u00e4llningstid i samma f\u00f6retag eller anst\u00e4llningstid fr\u00e5n andra arbetsgivare efter en verksamhets\u00f6verg\u00e5ng f\u00f6religger s\u00e5ledes inte. Ber\u00e4kning av <u>sammanlagd<\/u> anst\u00e4llningstid enligt 3 \u00a7 LAS g\u00e4ller allts\u00e5 i<u>nte<\/u> f\u00f6r denna kollektivavtalsregel.<\/p>\n<p><strong>Undantag<\/strong><\/p>\n<p>Tv\u00e5 undantag fr\u00e5n denna huvudregel avseende regeln om f\u00f6rl\u00e4ngd upps\u00e4gningstid f\u00f6religger dock.<\/p>\n<ol>\n<li>Byter en arbetstagare anst\u00e4llning inom en koncern utan uppeh\u00e5ll mellan anst\u00e4llningarna beaktas \u00e4ven anst\u00e4llningstid hos det tidigare koncernbolaget vid till\u00e4mpning av regeln om f\u00f6rl\u00e4ngd upps\u00e4gningstid i samband med upps\u00e4gning p\u00e5 grund av arbetsbrist hos det senare koncernbolaget.<\/li>\n<li>N\u00e4r en anst\u00e4llning \u00f6verg\u00e5tt fr\u00e5n en arbetsgivare till en annan genom en verksamhets\u00f6verg\u00e5ng enligt \u00a7 6 b LAS och f\u00f6rv\u00e4rvaren redan \u00e4r bunden av ett kollektivavtal kan f\u00f6rv\u00e4rvaren under h\u00f6gst ett \u00e5r vara skyldig att ge den f\u00f6rl\u00e4ngda upps\u00e4gningstiden. Detta f\u00f6ruts\u00e4tter dock att en motsvarande regel om f\u00f6rl\u00e4ngd upps\u00e4gningstid f\u00f6religger i \u00f6verl\u00e5tarens kollektivavtal och att f\u00f6ruts\u00e4ttningarna enligt regeln \u00e4r uppfyllda (55 \u00e5r och sammanh\u00e4ngande anst\u00e4llningstid om minst 10 \u00e5r p\u00e5 upps\u00e4gningsdagen). Det beror p\u00e5 att f\u00f6rv\u00e4rvaren \u00e4r skyldig att forts\u00e4tta att till\u00e4mpa villkor i \u00f6verl\u00e5tarens kollektivavtal i h\u00f6gst ett \u00e5r. En kortare tid kan g\u00e4lla om ett nytt kollektivavtal tr\u00e4ffats hos f\u00f6rv\u00e4rvaren, till exempel genom ett inrangeringsavtal eller om \u00f6verl\u00e5tarens kollektivavtal l\u00f6pt ut innan det g\u00e5tt ett \u00e5r fr\u00e5n \u00f6verg\u00e5ngen.<\/li>\n<\/ol>\n<p>Skulle f\u00f6rv\u00e4rvaren efter en verksamhets\u00f6verg\u00e5ng p\u00e5 grund av arbetsbrist s\u00e4ga upp personal som \u00f6verg\u00e5tt och det sker under den period d\u00e5 f\u00f6rv\u00e4rvaren \u00e4r skyldig att till\u00e4mpa villkoren i \u00f6verl\u00e5tarens kollektivavtal (h\u00f6gst ett \u00e5r fr\u00e5n \u00f6verg\u00e5ngen) m\u00e5ste s\u00e5ledes \u00e4ven sammanh\u00e4ngande anst\u00e4llningstid hos \u00f6verl\u00e5taren beaktas om en motsvarande regel f\u00f6rel\u00e5g i \u00f6verl\u00e5tarens kollektivavtal. Efter denna period g\u00e4ller villkoren i f\u00f6rv\u00e4rvarens kollektivavtal som inneb\u00e4r att det enbart \u00e4r anst\u00e4llningstid hos f\u00f6rv\u00e4rvaren som r\u00e4knas, fr\u00e5n och med \u00f6verg\u00e5ngen.<\/p>\n<p><strong>Observera<\/strong><\/p>\n<p>Inneb\u00f6rden av den kollektivavtalade best\u00e4mmelsen \u00e4r den som ovan beskrivits \u00e4ven om texten skiljer sig \u00e5t mellan olika kollektivavtal med t ex f\u00f6rtydliganden om att den sammanh\u00e4ngande anst\u00e4llningen ska ha varit i \u201df\u00f6retaget\u201d eller hos \u201darbetsgivaren\u201d. Sk\u00e4let \u00e4r att best\u00e4mmelsen har sitt ursprung ur 1994 \u00e5rs omst\u00e4llningsavtal mellan d\u00e5varande SAF och PTK. Inneb\u00f6rden av regeln i omst\u00e4llningsavtalet var att anst\u00e4llningstiden skulle vara sammanh\u00e4ngande i \u201df\u00f6retaget\u201d eller hos \u201darbetsgivaren\u201d \u00e4ven om det inte kom till uttryck i texten.<\/p>\n<p>Med stor sannolikhet kommer v\u00e5ra fackliga motparter att framgent i samband med inrangeringsf\u00f6rhandlingar i anledning av verksamhets\u00f6verg\u00e5ngar f\u00f6rs\u00f6ka f\u00e5 reglerat en skyldighet f\u00f6r f\u00f6rv\u00e4rvare att ber\u00e4kna anst\u00e4llningstid p\u00e5 ett f\u00f6r arbetstagarna mer f\u00f6rdelaktigt vis \u00e4n vad regeln inneb\u00e4r. N\u00e5gon skyldighet att acceptera s\u00e5dana f\u00f6rslag finns naturligtvis inte.<\/p>\n<p>Det kan ocks\u00e5 vara s\u00e5 att v\u00e5ra fackliga motparter p\u00e5st\u00e5r att f\u00f6rv\u00e4rvaren ska forts\u00e4tta att till\u00e4mpa regeln i \u00f6verl\u00e5tarens kollektivavtal l\u00e4ngre tid \u00e4n max ett \u00e5r efter \u00f6verg\u00e5ngen f\u00f6r det fall inte f\u00f6rv\u00e4rvarens kollektivavtal l\u00f6pt ut och ersatts av ett nytt. N\u00e5gon r\u00e4ttslig grund f\u00f6r en s\u00e5dan inst\u00e4llning f\u00f6religger dock inte enligt v\u00e5r bed\u00f6mning.<\/p>\n<p>H\u00e4r finner du l\u00e4nk till de avg\u00f6randen som var den riktiga.<\/p>\n<p><a href=\"http:\/\/www.arbetsdomstolen.se\/upload\/pdf\/2014\/69-14.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">http:\/\/www.arbetsdomstolen.se\/upload\/pdf\/2014\/69-14.pdf<\/a><\/p>\n<p>Beslutet om att fr\u00e5ga EU-domstolen om arbetsgivarsidans till\u00e4mpning av best\u00e4mmelsen stred mot EU-r\u00e4tten.<\/p>\n<p><a href=\"http:\/\/curia.europa.eu\/juris\/document\/document_print.jsf?doclang=SV&amp;text=&amp;pageIndex=0&amp;part=1&amp;mode=req&amp;docid=189650&amp;occ=first&amp;dir=&amp;cid=502494\" target=\"_blank\" rel=\"noopener fr\u00e5n EU-domstolen som klargjorde att en f\u00f6rv\u00e4rvare kunde ha och till\u00e4mpa en kollektivavtalsregel som innebar att anst\u00e4llningstid hos \u00f6verl\u00e5taren inte beaktas och s\u00e5ledes var till nackdel f\u00f6r den \u00f6vertagna personalen.<\/p>\n<p><a href=\"http:\/\/www.arbetsdomstolen.se\/upload\/pdf\/2018\/35-18.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">http:\/\/www.arbetsdomstolen.se\/upload\/pdf\/2018\/35-18.pdf<\/a><\/p>\n<p>Arbetsdomstolen konstaterade, i enlighet med EU-domstolens dom, att arbetsgivarsidans till\u00e4mpning av regeln om f\u00f6rl\u00e4ngd upps\u00e4gningstid inte stod i strid med EU-r\u00e4tten trots att regeln var till nackdel f\u00f6r den \u00f6vertagna
