{"id":17377,"date":"2018-05-09T10:56:25","date_gmt":"2018-05-09T08:56:25","guid":{"rendered":"https:\/\/www.almega.se\/?p=17377"},"modified":"2022-03-28T11:00:59","modified_gmt":"2022-03-28T09:00:59","slug":"krav-pa-plan-for-atergang-i-arbete-fryshus","status":"publish","type":"post","link":"https:\/\/www.almega.se\/2018\/05\/krav-pa-plan-for-atergang-i-arbete-fryshus\/","title":{"rendered":"Krav p\u00e5 plan f\u00f6r \u00e5terg\u00e5ng i arbete &#8211; (Fryshus)"},"content":{"rendered":"\n<h2><strong>Fryshus \u2013 Krav p\u00e5 plan f\u00f6r \u00e5terg\u00e5ng i arbete<\/strong><\/h2>\n<p>Fr\u00e5n och med den 1 juli 2018 inf\u00f6rs nya regler i Socialf\u00f6rs\u00e4kringsbalkens 30 kapitel 6 \u00a7 om arbetsgivarens skyldighet att planera insatser som underl\u00e4ttar anst\u00e4lldes \u00e5terg\u00e5ng vid sjukskrivning.<\/p>\n<p>Dessa inneb\u00e4r att en plan f\u00f6r \u00e5terg\u00e5ng i arbete ska vara uppr\u00e4ttad senast n\u00e4r den anst\u00e4llde varit sjukskriven i 30 dagar, om det kan antas att hans eller hennes arbetsf\u00f6rm\u00e5ga kommer att vara nedsatt p\u00e5 grund av sjukdom under minst 60 dagar. Om det med h\u00e4nsyn till den anst\u00e4lldes h\u00e4lsotillst\u00e5nd klart framg\u00e5r att denne inte kan \u00e5terg\u00e5 i arbete beh\u00f6ver det inte uppr\u00e4ttas n\u00e5gon plan.<\/p>\n<p>F\u00f6r p\u00e5g\u00e5ende sjukfall som vid ikrafttr\u00e4dandet den 1 juli 2018 varat eller antas p\u00e5g\u00e5 minst 60 dagar ska en plan ha uppr\u00e4ttats senast den 30 september 2018.<\/p>\n<p>Planen f\u00f6r \u00e5terg\u00e5ng i arbete ska, i den utstr\u00e4ckning det \u00e4r m\u00f6jligt, uppr\u00e4ttas i samr\u00e5d med den anst\u00e4llde. Arbetsgivaren \u00e4r skyldig att fortl\u00f6pande se till att planen f\u00f6ljs och att det vid behov g\u00f6rs \u00e4ndringar i den. Begreppet rehabiliteringsplan \u00e4r kvar. F\u00f6rs\u00e4kringskassan \u00e4r alltj\u00e4mt ansvarig (30 kapitlet 12-13 \u00a7\u00a7 Socialf\u00f6rs\u00e4kringsbalken). Det ska inte blandas ihop med kravet p\u00e5 arbetsgivaren i 30 kapitlet 6 \u00a7 om en plan f\u00f6r \u00e5terg\u00e5ng i arbete. Den formella rehabiliteringsplanen tar F\u00f6rs\u00e4kringskassan fram n\u00e4r en f\u00f6rs\u00e4krad i en rehabiliterings\u00e5tg\u00e4rd kommer ifr\u00e5ga f\u00f6r rehabiliteringsers\u00e4ttning.<\/p>\n<p>\u00c4ndringen inneb\u00e4r ocks\u00e5 att st\u00f6det f\u00f6r att stimulera och underl\u00e4tta arbetsplatsinriktade rehabiliteringsinsatser utvidgas. Detta kommer inneb\u00e4ra att det arbetsplatsn\u00e4ra st\u00f6det till arbetsgivaren ska kunna l\u00e4mnas med ett tak p\u00e5 10 000 kronor per arbetstagare och kalender\u00e5r. Nuvarande st\u00f6d inneb\u00e4r 7000 kronor per insats och \u00e5r.
