Hela domarna hittar du p\u00e5 Arbetsdomstolen hemsida via l\u00e4nken under kommentarer.<\/p>\n<p><strong>AD 2019 nr 35<\/strong><\/p>\n<p>Fr\u00e5ga i m\u00e5let g\u00e4llde om arbetsgivaren, ett bolag inom byggbranschen, haft laga grund f\u00f6r avskedande av en arbetstagare, som enligt arbetsgivaren tillsammans och i samf\u00f6rst\u00e5nd med \u00e5tminstone en person till, tagit diverse byggnadsmaterial fr\u00e5n arbetsgivaren. M\u00e5let g\u00e4llde \u00e4ven fr\u00e5ga om bolaget hade en kvittningsgill motfordran mot arbetstagarens anspr\u00e5k p\u00e5 allm\u00e4nt skadest\u00e5nd.<\/p>\n<p>Arbetsgivaren \u00e5beropade fyra olika h\u00e4ndelser till grund f\u00f6r avskedet, varav Arbetsdomstolen pr\u00f6vade ett. Arbetsgivaren gjorde g\u00e4llande att arbetstagaren viss dag, tillsammans med \u00e5tminstone en annan person, stulit diverse byggmaterial fr\u00e5n bolaget. Tv\u00e5 vittnen \u00e5beropades av arbetsgivaren som enligt Arbetsdomstolen samst\u00e4mmigt och detaljerat uppgett att de p\u00e5 en \u00f6vervakningsfilm sett, i vart fall tv\u00e5 personer, k\u00f6ra in p\u00e5 bolagets omr\u00e5de med en sk\u00e5pbil och tillh\u00f6rande sl\u00e4pk\u00e4rra som de lastat fulla med diverse byggmaterial. B\u00e5da vittnena kunde, enligt Arbetsdomstolens bevisv\u00e4rdering av f\u00f6rh\u00f6ren, med s\u00e4kerhet identifiera en av personerna som den aktuella arbetstagaren. De uppgav att \u00e4ven denna arbetstagare burit n\u00e5gonting innanf\u00f6r jackan som han sedermera lagt in i sk\u00e5pbilen.<\/p>\n<p>Att \u00f6vervakningsfilmen ifr\u00e5ga f\u00f6rsvunnit innebar inte enligt Arbetsdomstolen att det fanns anledning att ifr\u00e5gas\u00e4tta vad bolaget p\u00e5st\u00e5tt ang\u00e5ende h\u00e4ndelsen. Arbetsdomstolen h\u00e4nvisade till sin tidigare praxis d\u00e4r man funnit en identifiering st\u00e4lld utom rimligt tvivel n\u00e4r en person, utifr\u00e5n en filmsekvens, identifierats av tv\u00e5 vittnen som var v\u00e4lbekanta med g\u00e4rningsmannen sedan tidigare. Enligt Arbetsdomstolen var ett arbetsgivarens vittnen, till skillnad fr\u00e5n vad tingsr\u00e4tten funnit vid den tidigare pr\u00f6vningen, 100 procent s\u00e4ker att det var den aktuella arbetstagaren han s\u00e5g p\u00e5 filmen. Vittnet hade tr\u00e4ffat arbetstagaren tidigare och k\u00e4nde till honom vid namn. Arbetsdomstolen f\u00e4ste d\u00e4rmed tilltro till hans uppgifter. Genom de tv\u00e5 vittnena fann Arbetsdomstolen s\u00e5ledes st\u00e4llt utom rimligt tvivel att arbetstagaren, tillsammans med \u00e5tminstone en person, tillgripit diverse byggnadsmaterial fr\u00e5n bolagets omr\u00e5de till ett inte obetydligt v\u00e4rde. Tillgreppet riktade sig mot bolaget, hade beg\u00e5tts p\u00e5 arbetsplatsen och n\u00e5gra f\u00f6rmildrande omst\u00e4ndigheter hade inte framkommit. Arbetsdomstolens slutsats blev s\u00e5ledes att bolaget hade haft laga grund f\u00f6r avskedet. Det saknades d\u00e4rmed anledning att pr\u00f6va de \u00f6vriga omst\u00e4ndigheter som bolaget lagt till grund f\u00f6r avskedet.<\/p>\n<p>Arbetsdomstolen fann att arbetsgivarens besked om avsked inte uppfyllde formaliakraven i 19 \u00a7 LAS. Arbetsgivaren hade \u00e4ven betalat ut semesterers\u00e4ttning senare \u00e4n vad som f\u00f6reskrivs i 30 \u00a7 semesterlagen. Arbetstagaren hade s\u00e5ledes r\u00e4tt till allm\u00e4nt skadest\u00e5nd f\u00f6r brott mot best\u00e4mmelserna. Arbetsgivaren befanns \u00e4ven ha underl\u00e5tit att betala slutl\u00f6n till arbetstagaren. Arbetsgivaren gjorde g\u00e4llande att det hade en kvittningsgill motfordran gentemot arbetstagaren avseende den ekonomiska skada som bolaget drabbats av till f\u00f6ljd av agerandena som bolaget lagt till grund f\u00f6r avskedet. Arbetsdomstolen fann dock att arbetsgivaren endast anf\u00f6rt vaga kostnadsuppskattningar genom \u00e5beropade f\u00f6rh\u00f6r. N\u00e5gon ytterligare bevisning framf\u00f6rdes inte. Bevisl\u00e4ttnadsregeln i 35 kap. 5 \u00a7 r\u00e4tteg\u00e5ngsbalken om att skadest\u00e5nd kan best\u00e4mmas till ett sk\u00e4ligt belopp f\u00f6ruts\u00e4tter att det \u00e4r fr\u00e5ga om annat \u00e4n mindre belopp och att full bevisning om skadan inte alls eller endast med sv\u00e5righet kan f\u00f6ras. Den p\u00e5st\u00e5dda skadan i tvisten var inte enligt arbetsgivaren ett mindre belopp. Skadan var \u00e4ven av s\u00e5dan karakt\u00e4r att arbetsgivaren, enligt Arbetsdomstolens mening, utan st\u00f6rre sv\u00e5righeter hade kunnat presentera utredning i form av t ex inventeringsdokumentation och kvitton. Arbetsdomstolen fann s\u00e5ledes att arbetsgivaren inte hade styrkt sin p\u00e5st\u00e5dda skada och att n\u00e5gon kvittningsgill motfordran inte kunde g\u00f6ras g\u00e4llande.<\/p>\n<p><strong>AD 2019 nr 36<\/strong><\/p>\n<p>En fackf\u00f6rening yrkade skadest\u00e5nd av ett bolag f\u00f6r brott mot f\u00f6rhandlingsskyldigheten i MBL. F\u00f6reningen hade skickat f\u00f6rhandlingsframst\u00e4llningar g\u00e4llande sina medlemmar och p\u00e5minnelser med rekommenderat brev till bolagets postadress. Bolaget h\u00e4mtade inte ut n\u00e5got av breven. F\u00f6reningen gjorde inte g\u00e4llande att f\u00f6rhandling p\u00e5kallats p\u00e5 n\u00e5got annat s\u00e4tt.<\/p>\n<p>D\u00e5 bolaget inte inkom med svarom\u00e5l blev det fr\u00e5ga om Arbetsdomstolen kunde meddela tredskodom. Arbetsdomstolen konstaterade att en tredskodom mot svaranden ska grundas p\u00e5 k\u00e4randens framst\u00e4llning av omst\u00e4ndigheterna i m\u00e5let, s\u00e5vitt svaranden f\u00e5tt del av framst\u00e4llningen och den inte strider mot f\u00f6rh\u00e5llande som \u00e4r allm\u00e4nt veterligt. K\u00e4randens talan ska dock avsl\u00e5s om de omst\u00e4ndigheter som framf\u00f6rts inte innefattar laga sk\u00e4l f\u00f6r talan eller p\u00e5 annat s\u00e4tt \u00e4r uppenbart ogrundad.<\/p>\n<p>Enligt Arbetsdomstolen f\u00f6rutsatte ett bifall till fackf\u00f6reningens talan om skadest\u00e5nd att bolaget m\u00e5ste ha f\u00e5tt del av f\u00f6rhandlingsframst\u00e4llningarna. Det som f\u00f6reningen gjort g\u00e4llande innebar inte enligt domstolens bed\u00f6mning att bolaget f\u00e5tt del av f\u00f6rhandlingsframst\u00e4llningarna i den mening som avses med 16 \u00a7 andra stycket MBL.
